General terms and conditions

1. Validity and definition of basic terms

  1. These General Terms and Conditions apply to the provision of internet services by the operator on servers operated by the operator and partner real estate servers.
  2. The BEZREALIT.EU network is a portal for advertising real estate from the real estate market and housing.
  3. Partner servers are third-party servers that display the content of the BEZREALIT.EU network on their servers based on a contract with the company 74804138.
  4. BEZREALIT.EU is a sign protected by a trademark.
  5. The operator of the BEZREALIT.EU internet network and all its regional mutations is the company Ing.Viktor Mahdal with its registered office at Holečkova 59, 15000 Prague, ID number: 74804138
  6. Paid services are the sum of services that the operator provides on the servers operated by it to persons within the framework of the contract, who can, based on these services, use the potential of visitors to the BEZREALIT.EU network server to present their name and their real estate or services.
  7. The customer is a natural or legal person or organization that has ordered and paid for the provided internet services with the operator or the operator’s dealer.
  8. A seller is a person who, based on a contract with the operator, represents the operator as an intermediary or acts in his own name as a sales representative in the provision of the operator’s internet services.
  9. The server operator is a person on the operator’s side, ensuring that the customer displays information on the server for the operator’s services to the customer. However, information can also be entered online via the service section.
  10. Paid registration is an act on the basis of which the customer’s right to actively advertise real estate and use services within the BEZREALIT.EU network arises.
  11. The service section is a space on the BEZREALIT.EU network, which is secured by a username and password and serves for the online administration of the company’s presentation and paid services by the customer.
  12. A binding order is an act of the customer with the effects of a contract if it is signed, accepted and fulfilled by the operator.
  13. Paid services in accordance with these General Terms and Conditions are provided on the basis of an order or payment of an issued advance invoice.
  14. The service comes into force on the following day after payment of the agreed amount for the service by the customer or crediting to the operator’s account. Termination of the service is governed by the date indicated in the written order or on the advance invoice. The service start date indicated on the order is only indicative in case of earlier or later payment.
  15. The server is a system of technical and organizational resources of the provider that is connected to the Internet.
  16. The Internet network is an environment made up of the provider’s computer network and technical resources and the computer networks and resources of third parties.

2. Internet services provided, prices for services, their billing and payments

  1. The price for commercial advertising is calculated according to the valid price list, which is an integral part of these General Terms and Conditions. The prices listed in the price list do not include VAT, which is charged according to the applicable value added tax law. The operator always implements special or atypical commercial projects outside of the price list conditions by agreement and at a contractual price.
  2. On the basis of the order concluded between the operator and the customer, the operator issues an advance invoice with the specified start and end date of the paid registration.
  3. In the event of a delay in payment after the due date of the advance invoice, the customer does not have the right to postpone the start and therefore the end of the service.
  4. On the day the amount from the advance invoice is credited to the operator’s account, the operator will issue an invoice – a tax document and start the ordered service for the customer
  5. In the event of a delay in starting the service by the operator, the service will be extended by the missing authorized days.
  6. The cancellation fee for canceling a binding order is CZK 1,000 including VAT and is payable 7 days after the order cancellation date.
  7. Based on paid registration, the operator activates the administration of ordered services in the service section, and the customer has the right to remote user support.
  8. The operator will provide online access to the history of requests and questions about real estate in the service section of the Client portal

Real estate advertiser – customer of services:

  1. The customer can grant consent to the processing of personal and other data to the Operator under the conditions stated here in several ways:
    • by checking the box in the entry or registration form on the Operator’s servers
    • by exporting data from the Advertiser or a person authorized by him towards the Operator
    • by sending a request by e-mail
    • by signing a contract or other legal document indicating consent
    • by paying the invoice and thereby agreeing to the General Terms and Conditions
  2. The customer acknowledges that all contact information entered by him to be published on the BEZREALIT.EU network, whether through the service section, through server operators or in another way, is entered for the purpose of publication, and therefore will be presented to an unlimited extent to all Internet users and can be provided to third parties.
  3. The operator is authorized to process the personal data of the Customer (natural person) or his employees and associates to the extent that the Customer entered them during registration, through the service section, through server operators, by exporting data or in another way. The scope of processed personal data is always defined by the relevant form or export specification with the option to save the IP address. The Customer acknowledges that for all provided personal data of third parties entrusted by the Customer to the Operator, he has duly contractually secured consents to processing for publication on the Operator’s servers, commercial communications by the Operator to the extent and purpose that is absolutely necessary.
  4. The Customer’s personal data is processed for the purpose of fulfilling the contractual obligations of the Operator, for the purpose of maintaining a database of relations with Advertisers’ customers (CRM) and recording the fulfillment of obligations by both contractual parties or improving the quality of the Operator’s services. The Customer agrees to the publication of his or entrusted personal data on the Operator’s servers or operated by the Operator, in particular for the purpose of publicly providing contact information to third parties as part of the Customer’s offer or his profile.
  5. The operator is entitled to store the Customer’s personal data for the duration of the Customer’s account or offer registration, whether in paid or unpaid mode, but no longer than for a period of 10 years from the last login, control or update of data by the Customer or from the time of the last consent to the processing of personal data from The customer.
  6. The customer can revoke his consent at any time free of charge by sending a request to the address info@bezrealit.eu
  7. The provider is not responsible for damages caused by users as a result of an Internet outage, delayed delivery or damage to data during transmission. The provider is not responsible for damages caused by the transmission of classified data.

The Provider is entitled to send information about its product, its improvements, tips for increasing efficiency and business information relating to the product used by the Client to all the contact details entered by it.

4. Rights and obligations of the customer

  1. The customer undertakes to comply with the “advertising rules”, which are an integral part of these general terms and conditions
  2. When using the services, the customer may not interfere with the operator’s computer system other than via an Internet browser of the HTTP protocol or software supplied by the server operator. To connect to the system’s servers, the user undertakes to use only such technical means as are recommended by the system operator, to follow the operator’s instructions and, last but not least, not to attempt unauthorized (unauthorized) entry or manipulation of data in the BEZREALIT.EU network.
  3. The customer is obliged to keep the access name (login) and password determined by registration confidential and not to disclose them to third parties. Otherwise, the user is responsible for misuse of the account by a third person or entity, whether with or without the knowledge of the customer. The customer undertakes to inform the operator in case of detection of any misuse or suspicion of misuse of his access rights in the BEZREALIT.EU system.
  4. The client bears full responsibility for the quality and formal and content side of the advertising message placed on the operator’s advertising surfaces. The orderer gives the operator, at the same time as the delivery of the advertising materials, consent to the dissemination of the given advertising message via the operator’s Servers and also simultaneously confirms that he is an entity authorized to exercise all the necessary rights to the advertising message, which will be placed on one of the operator’s Servers. The client further confirms that it is entitled to exercise any proprietary copyrights to the relevant advertising message and/or to other advertising elements and is entitled to use any trademarks or other elements that are subject to industrial or intellectual property protection contained in the advertising message, and confirms , that it does not infringe the rights of any other third party.
  5. The customer undertakes to provide only true and undistorted data for the advertised products and services, both in textual and audiovisual form. Furthermore, the customer undertakes not to condition the provision of more detailed information on the advertised products and services with a fee-based registration on the website or at the branch.
  6. The customer undertakes to advertise only those properties for which the owner of the property or his legal representative has been authorized to do this activity by an intermediary contract or other legal relationship (e.g. a real estate agency) or the customer is authorized to do this activity by a relevant intermediary in the contractual relationship (a real estate broker with a contract with a real estate agency, advertising agency).
  7. If the subject of the agreed service is mediation of access to another computer system (network), the user must respect the conditions of access and protection to this system (network).
  8. Registration and private advertising are in no way intended for intermediaries, construction companies, development companies, real estate agencies or other legal entities operating in related fields. The operator of the BEZREALIT.EU server reserves the right to delete the resulting registration, including the entire advertisement, and to recover an amount corresponding to the length and scope of the unauthorized advertisement.
  9. Persons or companies violating the general terms and conditions in this way are subject to a contractual fine of up to CZK 100,000 (in words: one hundred Runčeských) for each individual violation. The contractual penalty clause does not affect the claim for damages.
  10. The Customer acknowledges that when purchasing advertising space in exclusive mode (i.e. the advertising space or service is intended in its entirety in a given time frame only for one Customer), a situation may arise when others appear on this space, i.e. competitive, advertising message.

5. Rights and obligations of the operator

  1. It is in the interest of the operator to ensure the high-quality, error-free and long-term operation of the BEZREALIT.EU network, and therefore undertakes to ensure the operation of this network to the maximum extent possible. The operator is obliged to respond to reports of system malfunctions from users within a reasonably long time. If the system is shut down for a period longer than 12 hours, which the operator will plan in advance, he is obliged to inform the system user via e-mail.
  2. The operator ensures the operation of export programs and the service section for inserting advertising and editing the presentation.
  3. The operator undertakes to provide support and solve problems with the use of the network. Communication channels for solving problems are: e-mail, telephone counseling, publication of information on the operator’s website.
  4. The operator does not provide a guarantee of continuous functionality, error-free operation and security of the BEZREALIT.EU system. It is to the benefit of the operator to provide all services and functions of the system to the customer and all visitors in the highest possible quality.
  5. The operator bears no responsibility for damages caused to the customer by the operation or failure of the servers of the BEZREALIT.EU system.
  6. The system operator reserves the right to delete recordings that, in the opinion of the operator, will damage good morals or the name and interests of the operator or another entity by their actions or form.
  7. The operator reserves the right to freely modify and improve the BEZREALIT.EU system so that its functionality is not impaired.
  8. By agreeing to the sending of information by the operator to the customer, made in writing in the order, the operator is entitled to send its information materials by electronic or traditional mail. Withdrawal of consent by the customer must be made one month in advance in writing to the address of the operator.
  9. The operator has the right to use all inserted text and image information, inserted by the customer or through the operator on the BEZREALIT.EU network, for its other promotional activities. By the act of insertion, the customer gives him consent to the unlimited use of the work for the purposes of promoting the BEZREALIT.EU network. The operator is always obliged to publish the data source for each such work or information.
  10. To supplement the client’s presentation, the operator is entitled to use text and audiovisual elements that the client has published on its website or other promotional materials and to use them on the operator’s servers.
  11. The Customer acknowledges that the Operator may assign third-party advertising space to any advertisement that is not directly related to the Customer’s main business (e.g., a third-party mortgage calculator can be assigned to a real estate advertisement). The operator undertakes that if the customer does not agree with this advertisement and at his own expense he will make and provide an adequate own version of the advertising area (e.g. his own mortgage calculator), he will allow the customer to exchange these advertising areas for a fee according to the valid price list of the operator or in the usual amount .

6. Other arrangements

  1. The customer is obliged to send text information to the server operators in DOC, TXT or RTF formats. Photos, logos or graphic elements in GIF, JPEG formats. When different formats are used, the operator is not obliged to publish such data. The client is obliged to send corporate articles for publication at least 14 days in advance. In case of non-use of the option of publication of articles by the customer during the validity period of the service, these unused publications do not carry over into the next period of possible continuation of the service.
  2. WWW forms for online input of text and graphic information are available to the customer in the service section.
  3. For services that require manual input or proofreading by server operators, the operator reserves a period of 10 days to perform the necessary actions and insert them into the BEZREALIT.EU network.
  4. The customer is responsible for the content and legal admissibility of text and image templates uploaded to the operator’s website. The operator is not obliged to check whether they violate the rights of third parties. In the event of a claim by a third party in connection with the publication of a demonstrably false or legally inadmissible advertisement or graphic information, the customer assumes all and is obliged to compensate the operator for any damages incurred as a result of the aforementioned actions of the customer.
  5. The operator has the right not to accept an advertisement order from a customer who owes money for a previously provided service, or to suspend performance until the amount owed is paid.
  6. In the event of force majeure, the operator is released from responsibility for fulfilling obligations and providing compensation for damages.
  7. The operator bears no legal responsibility for the publication of articles supplied by the customer. The customer provides these articles to the operator for an unlimited period of time from the date of handover for publication on the servers operated by him. Any infringement of copyright in such an article is then solely the responsibility of the customer who supplied the article for publication.
  8. The customer is responsible for the received contact data of third parties obtained from the server operator (e.g. in the form of a request email) and undertakes not to misuse these contacts to send other business communications not related to the real estate market in the Czech Republic. In this case, the registration of this real estate agency will be canceled and advertising on the BEZREALIT.EU server will be disabled for the resulting misconduct. At the same time, however, the real estate agency may come into conflict with the applicable regulations of the Czech Republic or the European Union.

7. Complaints

  1. In the event of an error by the operator, the client is entitled to demand an adequate compensation within the complaint procedure, especially in the form of another advertising campaign.
  2. It is only possible to complain about advertising in writing, by registered letter to the address of the operator’s headquarters. Other forms of submitting a complaint are not considered properly applied.
  3. The deadline for making a complaint is 5 working days from the day the client discovered or could have discovered the error, but no later than the last day of the given campaign. The deadline for a decision on a complaint by the operator is 30 calendar days.
  4. Non-functionality of its services, which relate to the confirmed order of the client, is considered a fault on the part of the operator, with the exception of planned or short-term server outages.
  5. Reservations to issued invoices – tax documents must be made by the customer no later than 7 days after delivery of the invoice, in writing to the operator’s headquarters.

8. Final Provisions

  1. In case of gross or repeated violations of these General Terms and Conditions, the operator reserves the right to immediately terminate the service without financial compensation or compensation. If the customer’s violation of these general terms and conditions causes damage to the server operator, the customer is obliged to compensate the operator for this damage.
  2. By gaining access to the services of the BEZREALIT.EU system, the customer does not acquire the right to any copyrights, trademarks or other intellectual property rights of the operator.
  3. The validity of the General Terms and Conditions refers to the date of conclusion of the order and applies to a specific customer for the entire period of validity of the order. By extending the order or service, the customer acknowledges the currently valid General Terms and Conditions.
  4. All relationships not regulated by these General Terms and Conditions are governed by the applicable laws of the Czech Republic, in particular the Commercial Code. The operator reserves the right to change these terms and conditions without prior notice.
  5. These terms and conditions are valid and effective from 8/26/2024.

Advertising rules

  1. It is possible to place an advertisement using the website www.bezrealit.eu – Add item button.
  2. The inserted ad must be related to the focus of the server, i.e. real estate advertising. It is forbidden to insert images and texts that are not related to the content of the server, are offensive or racist and contradict the laws of the Czech Republic.
  3. The customer undertakes to fill in the individual fields in accordance with their purpose. At the same time, he undertakes to truthfully fill in as much information as possible about the advertised property. The customer bears full responsibility for all published information under the customer’s header.
  4. The customer undertakes to update the advertisement on the BEZREALIT.EU network within 24 hours after a change in the property’s status.
  5. A private ad that has been unchanged for 3 months will be automatically blocked. Unupdated advertisements of real estate agencies are blocked after 36 months.
  6. The basic sorting of real estate takes place automatically. The operator is not obliged to communicate the sorting criteria.
  7. The advertiser reserves the right not to display an ad that does not have all the mandatory data required by the service section or the current import specification.
  8. The advertiser is fully responsible for the truthfulness of the published data on the property and its completeness in terms of the applicable legislation of the Czech Republic (for example, publication of the energy label). In the event of failure to comply with this point, the advertiser assumes all possible legal consequences arising from it.
  9. The stated price must be true and include VAT. The customer may not use speculative prices to improve the statistics of the ad. The operator has the right to include such advertisements without notice until the end of the list, or to block them completely.
  10. Photos of the property must not contain a photo or watermark of the real estate agency
  11. The operator reserves the right to check all posted advertisements and, if it is found that the advertisement does not comply with the advertising rules, it has the right to block the advertisement without notice.
  12. It is forbidden to advertise individual type houses or projects that are not physically located on the land and are not at least in a state of rough construction. Turnkey type houses can only be advertised as part of a development project or in the category of the Turnkey Family Houses subtype.
  13. Posting duplicate ads is prohibited. In such cases, the operator has the right to block duplicate advertisements, and in case of repeated creation of duplicate advertisements by the customer, the operator can block the entire advertisement of the customer.
  14. It is prohibited to insert advertising links to other advertisements, business communications, names of competitors, URL addresses leading to other servers or other information unrelated to the nature of the advertisement and the BEZREALIT.EU network in the advertising text.

  1. A new property means a newly inserted property in the RK offer or a property that has not been actively advertised for more than 2 months. Re-exporting the same properties in order to manipulate the date and obtain the status of “new property” is prohibited. The operator reserves the right to use technical means in such cases to ensure that the property is still listed with the original insertion date. In addition, these activities on the part of the customer may be a reason to block the entire offer of the customer.
  2. Real estate update means, in particular, price updates or other changes that significantly change the condition or quality of the property offered. For example, adding a description, adding a photo or any other change related only to the quality of the advertised data cannot be considered an update. In these cases, the operator reserves the right to list the property with the original update date.
  3. For real estate exported through real estate programs, the operator has the right to shorten the description of the ad so that it corresponds to the technical conditions of display on the operator’s side.
  4. The price for advertising is governed by the valid price list. Payment is made online using GoPay.
  5. Private advertising is in no case intended for intermediaries, construction companies, development companies, real estate agencies or other legal entities operating in related fields. The operator of the BEZREALIT.EU server reserves the right to delete the resulting registration, including the entire advertisement, and to recover an amount corresponding to the length and scope of the unauthorized advertisement.
  6. A private advertiser can advertise 1 property.
  7. All privately posted ads are reviewed and then approved and published. The delay between insertion and publication of the ad is usually 1 working day.

Rules for real estate auctions

A real estate auction  , or competition for the best offer, is a fair and transparent way of selling in cases where several interested parties show or are expected to be interested in the purchase.

We organize  auctions with a secret price offer , which are commonly known in the Czech Republic under the name  Sale by envelope method . Classic envelopes are understandably on the decline in the 21st century, and in addition to submitting bids in envelopes, it is possible to submit an offer for purchase electronically via the auction system or by email.

The binding rules and conditions of the auction ensure a faultless and fair course of the auction.

  1. These rules and instructions for the real estate auction (collectively, hereinafter referred to as the ” Rules “) regulate the method of selection of the offer for the purchase of the property by the seller, which is mediated by the real estate agency  Apollo  (hereinafter referred to as the ” Auction “).
  2. The Seller, through the real estate agency specified in the Auction Conditions (hereinafter referred to as ” Apollo Office “), invites those interested parties who have expressed an interest in participating in the Auction to the Agency, to submit a binding offer for the purchase of the property (hereinafter referred to as ” Offer “).
  3. The interested party will receive an invitation to submit an Offer electronically to the contact email address provided by the interested party to the Office for that purpose or by placing the invitation on the website communicated by the interested party during the property inspection (hereinafter referred to as the ” Invitation “). The call consists of an accompanying report and its annexes. These are:
    1. Rules for real estate auctions;
    2. Document “Binding proposal for concluding a purchase contract” (hereinafter referred to as ” Binding proposal “);
    3. Specific conditions of the Auction (hereinafter referred to as ” Auction Conditions “);
    4. Draft Reservation Agreement (hereinafter referred to as the ” Agreement “);
    5. Auction number (ie auction code for electronic bid submission).
  4. Before submitting the Offer, the interested party shall check the completeness of the received Invitation and familiarize himself carefully with its entire content. Any questions regarding the content of the Invitation or details about the processing of personal data can be submitted in writing to the Apollo Office by means of the contact details provided in the Auction Terms and Conditions during the Bid submission deadline.
  5. An offer can only be submitted through a Binding Proposal. The binding proposal must contain the identification number of the property that is the subject of the Auction and to which the Offer applies or a clear identification of the offered  (hereinafter referred to as the ” Property “). Only one offer can be submitted for one specific property in one binding proposal, otherwise the offer will not be taken into account. The interested party fills in all the information required in the binding proposal truthfully and completely and attaches a handwritten signature.
  6. The completed Binding proposal will be delivered to the interested party via the auction system at the relevant property on the Bezrealit website. The interested party can also send the original completed Binding proposal electronically to the email of the organizing broker or in paper form to the address of the Apollo office. The deadline for submission and the method of delivery of Bids are determined by the Auction Conditions.
  7. By submitting an Offer, the interested party expressly declares that:
    1. The invitation was delivered to him at his request and is complete, he carefully familiarized himself with its content, especially with the Rules and Conditions of the auction, and agrees with the Invitation; and
    2. He is aware of the draft Agreement, which he is ready to negotiate with the seller and the Apollo Office, if the Apollo Office is invited to do so at the time the Offer is binding; and
    3. He undertakes to pay, on the basis of the concluded Agreement, the so-called blocking deposit, the amount of which is determined by the Auction Conditions, and he declares that he has sufficient financial resources to pay the blocking deposit;
    4. Is ready and seriously interested in acquiring ownership of the Property;
    5. Its Offer is governed by the Rules;
    6. All information is true and provided in good faith.
  8. Within the framework of one Auction, the interested party is entitled to change the Offer, and only until the closing date of the auction. The interested party is bound by the Offer until its termination according to these Rules.
  9. Offers that do not meet the conditions of the Call may not be evaluated by the seller.
  10. Bids received after the auction closing date will not be considered.
  11. The tender evaluation criteria are set out in the Auction Conditions. The interested party acknowledges that the evaluation criteria are set exclusively for better information of the interested parties, but remain essentially indicative. The seller reserves the right to choose the offer that suits him best. The terms of the auction may stipulate that the criteria are binding. In such a case, the seller cannot choose another most suitable offer.
  12. Bids will be evaluated within the deadline according to the Auction Conditions. It is considered that the Bidder’s Offer has lapsed upon the expiry of the period for evaluating the Bids, if the Bidder is not previously notified via contact email that his Bid has been selected. In this way, the Offers of all interested parties may expire.
  13. The interested party, whose Offer the seller has chosen, will receive an invitation to negotiate the Agreement to the provided contact email. The interested party undertakes within 2 working days from the delivery of the invitation to carry out all necessary legal actions for the Agreement to become valid and effective.
  14. If the time limit according to the previous point of these Conditions expires in vain, the interested party may, at the seller’s option, be granted an additional period to fulfill the obligation or may be directly excluded from the Auction. The interested party will be informed about the exclusion via the contact email address.
  15. An interested party who has violated his obligation according to point 13, or whose any confirmation or statement he provided in connection with the Auction turns out to be untrue, is obliged to pay the damage caused in full.
  16. All offers received are considered confidential. The Apollo office does not, in principle, disclose any information about the delivered bids to other bidders during or after the auction, with the exception of the notification of the winning price to bidders upon request, and only after the conclusion of the reservation contract between the seller and the winning bidder.
  17. RK Apollo reserves the right to change the Challenge without limitation. The change is effective the moment it is announced to the interested party (also via contact email). The interested party has the right to withdraw his Bid within a period of 1 week from the effective date of the changes to the Call, but at the latest before the deadline for submitting Bids, by a written message (also electronically) delivered to the Office, otherwise he is considered to have agreed to the change.
  18. The Apollo and Bezrealit.eu office is entitled to terminate the Property auction without reason or compensation. Claims for damages are excluded.
  19. The auction is governed by the Auction Conditions, these Rules and the relevant provisions  of Act No. 89/2012 Coll., Civil Code.
